Private Schools and Home Schools
 
  • The reauthorized Individuals with Disabilities Education Act (IDEA ’04) requires each school district to conduct timely and meaningful consultation with private school representatives prior to implementing child find activities to determine the number of parentally placed students with disabilities attending private schools located in the school district. Because the state treats students with disabilities in home schools, with regard to the provision of special education and related services, school districts must also effect timely and meaningful consultation with home school representatives and representatives of parents of students in home school programs.
  • To ensure meaningful consultation, the school district must consult with private school and home school representatives and representatives of parents of parentally placed private school students and home school students with disabilities during the design and development of special education and related services and any decision that affects the opportunities of eligible private and home school children.
 
Consultation with Private and Home School Representatives
 
The Jasper County Department of Special Services will schedule at the beginning of each school year a meeting for the
purpose of Consultation with Private and Home School Representatives during the course of each school year. These meetings will be held in August/September in the late afternoon to accommodate Private and Home School Representatives.
 
  • The Jasper County Department of Special Services will contact each Private and Home School representative in Jasper County regarding the consultation meeting via mail.
  • The Jasper County Department of Special Services will maintain a listing of all current Private and Home School Representatives in Jasper County.
  • The Jasper County Department of Special Services will present, as noted by an agenda, at each meeting, the following:
    • Greetings and introductions
    • Review of the Child Find Process/Student Intervention Team (SIT) Procedure via handout and PowerPoint presentation
    • Review of the Individual Service Plan (ISP)
    • Funding Allocation – the amount of funds Jasper County School District allocates to services for IDEA eligible parentally placed private school children is based on a formula that is provided to all school districts by the SC State Department of Education
    •  Request for participants to complete the Affirmation of Consultation with Private School and Home School Representatives Form
    • Forum for questions/discussion
  • The following topics will be discussed during the consultation process:
    • The child find process and how parentally placed private and home school students
      suspected of having a disability can participate equitably, including how parents,
      teachers, and private school officials will be informed of the process;
    • The consultation process among the school district, private and home school
      representatives, and representatives of parents of parentally placed private and
      home school representatives, will be presented once each school year to
      ensure that parentally placed private and home school students with disabilities
      identified through the child find process can meaningfully participate in special
      education and related services;
    • By whom special education and related services will be provided, including a
      discussion of types of services, including direct services and alternate service
      delivery mechanisms, how such services will be apportioned if funds are
      insufficient to serve all students, and how and when these decisions will be made,
    • How, if the school district disagrees with the views of the private and home school
      representatives on the provision of services or the types of services, whether
      provided directly, or through a contract, the school district will provide to the
      private and home school representatives a written explanation of the reasons why
      the school district chose not to provide services directly or through a contract.
    • All participants will be requested to sign-in at the meeting.
    • All participants will receive a packet at the meeting to include:
      • Student Intervention Team (SIT) Procedures
      • Child Find Info Sheet (English and Spanish)
      • Parent Guide to Special Education Services in South Carolina (English and Spanish)
      • Listing of Jasper County School District Principals and Student Intervention Team (SIT) Coordinators

  • Following each scheduled Consultation with Private and Home School Representatives, the Department of Special Services will collect and maintain the following records of the meeting held:
    • a copy of the letter of invitation for the Consultation Meeting that was sent to all private and home school representatives
    • a copy of the sign in sheet for the meeting
    • the meeting agenda
    • Signed Part I affirmation forms
    • Part II affirmation forms attesting that attempts at consultation were unsuccessful
Identification of a student with special needs in a private school or home school:
 
  • When a private school or home school suspects a student of requiring a referral for
    assistance, they will contact the MTSS/SIT Coordinator at the Jasper County School District  school that is in the
    zone in which the student resides. Any student requiring assistance is eligible for the MTSS/SIT process.
  • The private or home school will schedule a meeting to include the student’s parent(s), classroom teacher, and other relevant staff members at which the respective MTSS/SIT Coordinator and school psychologist will attend. The meeting will take place at the private school or home public school.
  • The team will follow the MTSS/SIT procedures, as outlined in the MTSS/SIT packet.
  • If the student meets eligibility as a student with a disability and requires special education services, only speech and language therapy will be addressed by the Jasper County School District if the student continues to attend the private or home school.
  • If speech services are to be provided, students 3-13 years of age will receive speech at their private or home school and students 14 years of age and older will receive speech at the Ridgeland Hardeeville High School.
  • If the parent chooses to enroll the student in the public school, and the student meets eligibility as a student with a disability and requires specialized instruction, an IEP will be developed by the IEP team and all special education services recommended will be provided.
